  1. Services Fyxser provides a platform connecting homeowners or individuals (“Service Seekers”) with independent contractors (“Service Providers”). Through the Service, we allow Service Providers to advertise their services and Service Seekers to post their requirements. We are not a party to any agreements, dealings, or transactions between Service Seekers and Service Providers, and we have no control over the conduct of either party.

  2. No Endorsement We do not endorse any Service Seekers or Service Providers. We do not confirm or verify any representations, qualifications, or abilities of Service Providers, nor the needs or requirements of Service Seekers. We highly recommend users of the Service to perform their diligence before entering into any agreement or transactions.

  3. No Guarantees Fyxser offers no guarantees, warranties, or assurances regarding (a) the truthfulness, accuracy, quality, or reliability of any user of the Service, their posts, their services, or their representations; (b) the performance, quality, or outcome of any services rendered based on connections made via the Service.

  4. Payments and Financial Terms Fyxser is not involved in the billing or payment process for services exchanged between Service Seekers and Service Providers. Any payment, billing, or financial arrangements are solely the responsibility of the users of the Service. Fyxser shall have no liability, obligation, or responsibility for any such correspondences, agreements, transactions, purchases, or services between you and any such third-party.

Limitation of Liability To the fullest extent permitted by applicable law, in no event will Fyxser, its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable to any person for any indirect, incidental, special, punitive, cover, or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use or content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if the liable party has been advised as to the possibility of such damages or could have foreseen such damages.

Indemnification You agree to indemnify and hold Fyxser and its affiliates, directors, officers, employees, and agents harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys’ fees, incurred in connection with or arising from any third-party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your use of the Services or any willful misconduct on your part.

9. CONTROLS FOR DO-NOT-TRACK FEATURES
 
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.
 
10. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?
 
In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.

Verification process
 
Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g., phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.
 
We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

  • You may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the information.
 
  • You can designate an authorized agent to make a request under the CCPA on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with the CCPA.
 
  • You may request to opt out from future selling of your personal information to third parties. Upon receiving an opt-out request, we will act upon the request as soon as feasibly possible, but no later than fifteen (15) days from the date of the request submission.
